Declarations of Trust & Advising on Trust Deeds
When a church is originally established, it is usually by a declaration of trust which sets out the trusts upon which the church buildings should be held. Often, old trust deeds very inadequately set out those trusts and we can advise on updating the trusts, or replacing the trusts with modern ones so far as the law allows. We can also advise on the drafting of declaration of trusts for new churches and the registration of churches as charities. We often give advice generally on the interpretation of provisions in trust deeds and how old provisions can be applied in the modern world.
